If a user is subject of a complaint because of how they’ve used the service to harm a third-party, there’s no reason the service should be responsible for it.
- Exclusion of liability
Terms of Service; Didn't Read - Phoenix - This exclusion of liability seems to be a must-have clause in ToS, thus turning the case to neutral might draw tosdr users attention to bad cases that would make the difference between services.
- License to distribute user content (2 cases)
Terms of Service; Didn't Read - Phoenix and Terms of Service; Didn't Read - Phoenix As discussed in this post , it unfairly penalizes open source services
- No guarantee over uninterrupted service
Terms of Service; Didn't Read - Phoenix -If the service does guarantee uninterrupted service (which is rare) it is already covered by Terms of Service; Didn't Read - Phoenix, on the contrary, most services (including ToS;DR) can’t guarantee there will be no downtimes.
